Is there a way to have a pad create to a plane on one layer and not another?

I have been asked to recreate a board from a gerber data and a schematic. They provided an older version of the board so basically I have been checking it against the schematic and gbr files. Layers 2 and 3 are planes with lines drawn to isolate agnd and gnd copper. The problems I am having are with thermals generated for agnd. On the gerber files all pads (agnd) are creating thermals on layer 3 however only 2 of the pads create thermals on layer 2 the rest are not connected. Is there a way to have a pad create to a plane on one layer and not another?

On the old file layer 3 is defined as (agnd) plane and layer 2 is defined as (gnd) plane so my only guess is that they switched the 2 pads to gnd prior to running gerbers for layer 2 allowing the lines  to partition the planes and than switched it back after wards.

My goal is to have layer 2 be a plane with agdn and gnd and only connect to agnd at those 2 points.
